Filing a Takedown Notice
Under 17 USC §512(c)(3), a valid DMCA takedown notice must contain the following six elements:
- 1Physical or electronic signature of the copyright owner (or authorized agent)
- 2Identification of the copyrighted work claimed to have been infringed
- 3Identification of the infringing material and the URL(s) where it appears on ViceForge
- 4Your contact information: name, address, phone number, and email
- 5A statement in good faith that the use of the material is not authorized by the copyright owner, its agent, or the law
- 6A statement under penalty of perjury that the information in the notice is accurate and that you are the copyright owner or authorized to act on their behalf
Counter-Notice
If you believe your content was removed in error under 17 USC §512(g), you may file a counter-notice. Your counter-notice must include:
- •Your physical or electronic signature
- •Identification of the removed material and its original URL
- •A statement under penalty of perjury that you believe the material was removed by mistake or misidentification
- •Your name, address, phone number, and consent to jurisdiction of the federal court in your district
Upon receiving a valid counter-notice, ViceForge will restore the content within 10–14 business days, unless the copyright owner files a court action.
Repeat Infringer Policy
ViceForge will, in appropriate circumstances, terminate the accounts of users who are repeat infringers of intellectual property rights.
Good Faith Warning
Filing false or misleading DMCA takedown notices may result in legal liability under 17 USC §512(f). If you are unsure whether the material infringes your copyright, we recommend consulting a legal professional before submitting a notice.
